Welcome to HIO Battery. These Terms & Conditions (“Terms”) govern your access to and use of hiobattery.com, the HIO Battery mobile application (“App”), customer and dealer accounts, purchases, forms, and services provided by HIO Power LLC, which operates the HIO Battery brand (“HIO Battery,” “we,” “our,” or “us”).

By accessing our website, downloading or using the App, creating an account, or placing an order, you agree to these Terms. If you do not agree, please do not use our website, App, or services.

1. General Use

You must be legally capable of entering into a binding agreement to use our website or App or to purchase products from us.

You agree to provide accurate, current, and complete information when placing an order, creating an account, or submitting a form.

You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account.

You may not use our website, App, or services for unlawful, fraudulent, abusive, or unauthorized purposes.

We may suspend or restrict access to an account when reasonably necessary to protect account security, investigate misuse, enforce these Terms, or comply with legal obligations.

Subject to these Terms, HIO Battery grants you a limited, personal, non-exclusive, non-transferable, and revocable right to install and use the App with compatible HIO Battery products.

You may not copy, modify, distribute, resell, reverse engineer, interfere with, or attempt unauthorized access to the App, connected products, software, firmware, or related systems, except where such restrictions are prohibited by applicable law.

2. Products and Orders

All products are subject to availability.

We reserve the right to:

  • Limit product quantities;
  • Modify or discontinue products;
  • Restrict sales to certain customers, accounts, locations, or applications;
  • Correct pricing, inventory, description, or specification errors; and
  • Refuse or cancel an order before fulfillment.

We make reasonable efforts to ensure that product descriptions, specifications, dimensions, compatibility information, images, and pricing are accurate. However, minor variations, production updates, display differences, or typographical errors may occur.

Product images are provided for general reference. Packaging, labels, accessories, colors, or components may vary without materially affecting the product’s intended function.

Submitting an order does not guarantee acceptance. Orders may be subject to product availability, payment authorization, account verification, fraud review, shipping restrictions, and final approval by HIO Battery.

If we cancel a paid order before fulfillment, we will refund the applicable amount paid for the cancelled products.

3. Product Compatibility and Performance

Customers are responsible for confirming that a product is appropriate for the intended vehicle, charger, controller, voltage, electrical system, and application before purchase or installation.

Battery range, runtime, charging time, speed, and performance information are estimates unless expressly guaranteed in writing.

Actual performance may vary based on factors such as:

  • Vehicle model and condition;
  • Motor and controller configuration;
  • Passenger and cargo weight;
  • Driving speed and driving style;
  • Road grade and terrain;
  • Temperature and weather;
  • Tire condition and pressure;
  • Accessory loads;
  • Installation quality;
  • Charging practices; and
  • Battery age and condition.

Performance estimates do not guarantee a specific driving distance, speed, number of holes, or operating time in every application.

4. Mobile App, Bluetooth, and OTA Updates

The App uses Bluetooth to discover and connect to compatible HIO Battery products and to display battery information such as voltage, current, temperature, state of charge, operating status, fault information, and firmware version.

Bluetooth connectivity and displayed information may be affected by distance, interference, mobile-device settings, battery hardware, firmware, or other technical conditions.

Information displayed in the App is provided for monitoring purposes and does not replace proper installation, physical inspection, product instructions, safety procedures, or professional diagnosis.

The App may connect to HIO Battery servers to verify compatibility and provide over-the-air (“OTA”) firmware updates.

OTA updates require a compatible product, sufficient battery power, a stable connection, and an uninterrupted update process. An interrupted or unsuccessful update may need to be restarted or may require technical assistance.

Do not operate or closely monitor the App while driving or when doing so could create a safety risk.

5. Pricing, Taxes, and Payments

Prices are shown in U.S. dollars unless otherwise stated and may change without notice.

Shipping, freight, taxes, duties, and other applicable charges may be added to the listed product price.

All payments must be made in full before shipment or pickup unless HIO Battery has separately approved written payment terms.

You agree to provide accurate billing and payment information and authorize HIO Battery and its payment service providers to process applicable charges.

Payment-card transactions may be processed by Shopify or other third-party payment providers. HIO Battery generally does not directly store complete payment-card numbers.

6. Dealer and Business Accounts

Dealer, wholesale, fleet, and commercial pricing is available only to approved accounts and may not be shared or transferred without authorization.

Any payment terms, credit limits, special pricing, deposits, rebates, or reward credits must be separately approved by HIO Battery.

Approved payment terms apply only to the account for which they were issued. We may place an account on hold or suspend payment terms because of overdue balances, payment history, credit risk, suspected misuse, or other reasonable business considerations.

Unless HIO Battery expressly agrees in writing, a customer purchase order or other customer document does not replace or modify these Terms.

7. Shipping, Delivery, and Pickup

Shipping and delivery dates are estimates unless expressly confirmed in writing.

We make reasonable efforts to ship orders within the time stated on the website, quotation, invoice, or order confirmation. If we cannot ship within the stated or legally applicable period, we may notify you of the delay and provide available options, including a revised shipping date or cancellation and refund of eligible unshipped products, as required by applicable law.

Shipping or delivery may be affected by:

  • Product availability;
  • Carrier or freight capacity;
  • Hazardous-material requirements;
  • Weather;
  • Customs;
  • Incorrect addresses;
  • Delivery-site restrictions; or
  • Other circumstances beyond our reasonable control.

HIO Battery is not responsible for carrier delays outside our reasonable control, but this does not limit rights that cannot be waived under applicable law.

Customers are responsible for providing an accurate and accessible delivery address. Additional carrier charges may apply for residential delivery, liftgate service, limited-access locations, address corrections, storage, redelivery, or other special services.

Customers should inspect shipments promptly. Visible damage or shortages should be noted on the carrier’s delivery receipt and reported to HIO Battery as soon as reasonably possible, together with photographs and supporting information.

For pickup orders, products are considered delivered when released to the customer or the customer’s authorized representative.

Unless different written shipping terms apply, risk of loss transfers to the customer when the products are delivered to the designated location or released for customer pickup.

8. Returns and Refunds

All returns require prior authorization from HIO Battery. Unauthorized returns may be refused.

Return eligibility may depend on the product condition, time since delivery, installation or use, original packaging, missing parts or accessories, shipping restrictions, and the reason for return.

Warranty-related returns are governed by the applicable HIO Warranty Policy. Any other return or refund arrangement must be approved by HIO Battery in writing.

Unless required by law or otherwise approved in writing, customers may be responsible for return shipping, freight, packaging, insurance, and related costs.

Approved refunds will generally be issued to the original payment method or handled according to the applicable dealer or account arrangement.

9. Limited Warranty and Safe Use

Eligible products are covered by the applicable written HIO Warranty Policy, which is incorporated into these Terms by reference and is available for review before purchase.

Warranty coverage, duration, claim procedures, remedies, exclusions, and customer responsibilities are described in that policy.

Warranty coverage may not apply to damage or failure caused by circumstances including:

  • Improper installation or wiring;
  • Incompatible equipment;
  • Incorrect charging;
  • Misuse or abuse;
  • Accident or physical damage;
  • Unauthorized modification;
  • Operation outside stated specifications;
  • Neglect; or
  • Water exposure beyond the product’s stated protection rating.

Battery systems store significant electrical energy. Products must be installed, charged, handled, transported, and used according to applicable instructions and safety requirements.

Installation and service should be performed by a qualified person familiar with the vehicle and electrical system.

Stop using a product and contact HIO Battery if there are signs of overheating, swelling, smoke, unusual odor, exposed wiring, physical damage, or another potentially unsafe condition.

Nothing in these Terms limits warranties, remedies, product-liability obligations, or consumer rights that cannot legally be excluded.

10. SMS and Other Communications

Providing a telephone number alone does not automatically enroll you in SMS communications.

When you affirmatively opt in through an applicable checkbox or other documented consent method, you agree to receive text messages from HIO Battery concerning matters such as:

  • Inquiries;
  • Orders and payments;
  • Shipping and delivery;
  • Pickup notifications;
  • Product registration;
  • Warranty matters;
  • Technical support; and
  • Customer service.

Message frequency may vary. Message and data rates may apply. Consent to receive text messages is not a condition of purchasing goods or services.

You may opt out at any time by replying STOP. For assistance, reply HELP or contact us at info@hiobattery.com.

Marketing text messages will be sent only where you have provided the applicable consent.

Our collection and use of telephone numbers and SMS consent are further described in our Privacy Policy.

11. Intellectual Property

The website, App, and their content, including HIO names, trademarks, logos, product images, text, graphics, videos, downloads, specifications, designs, software, firmware, and code, are owned by or licensed to HIO Battery and are protected by applicable intellectual-property laws.

You may not copy, reproduce, modify, distribute, sell, or use website or App content without authorization.

Approved HIO dealers may use materials expressly provided through HIO Dealer Resources or otherwise approved by HIO Battery solely to market and sell genuine HIO products, subject to applicable dealer terms and brand guidelines.

This permission does not include software, firmware, source code, confidential materials, or sublicensing rights.

12. Third-Party Services and Links

Our website may use or link to third-party services, including Shopify, SparkLayer, payment providers, shipping carriers, Google, Meta, and social-media platforms.

The App may be distributed through the Apple App Store and Google Play and may connect to HIO Battery services.

Your use of third-party platforms is subject to their applicable terms and privacy policies.

HIO Battery is not responsible for the independent content, availability, security, or practices of third-party services.

13. Website and App Availability

We make reasonable efforts to keep the website and App available, accurate, and secure. However, we do not guarantee that:

  • The website or App will always be available or uninterrupted;
  • Bluetooth connections will always remain active;
  • Every feature will be compatible with every mobile device, operating-system version, battery model, or firmware version;
  • Every error will be corrected immediately; or
  • All displayed information will always update in real time.

We may update, modify, suspend, or discontinue App features when reasonably necessary for security, compatibility, product support, maintenance, or continued operation.

Except for promises expressly stated in the applicable HIO Warranty Policy or another written agreement, website and App content is provided for general product, monitoring, and service information.

14. Limitation of Liability

To the maximum extent permitted by applicable law, HIO Battery will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of, or inability to use, the website, App, or services.

Product warranty claims are governed by the applicable HIO Warranty Policy and applicable law.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability that cannot legally be limited for fraud, willful misconduct, personal injury, defective products, or violation of applicable consumer-protection laws.

Some states do not allow certain exclusions or limitations of liability. In those states, the exclusions and limitations in these Terms will apply only to the fullest extent permitted by applicable law.

15. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles.

This choice of law does not eliminate mandatory consumer rights or protections that may apply under the laws of another state.

16. Changes to These Terms

We may update these Terms to reflect changes in our products, services, website or App features, business practices, service providers, or legal requirements.

When we update these Terms, we will revise the Last Updated date at the top of this page.

Material changes will apply prospectively unless otherwise permitted or required by law. Where required, we may provide additional notice through the website, App, email, account notification, or another appropriate method.

Continued use of the website, App, or services after updated Terms take effect constitutes acceptance of the revised Terms to the extent permitted by law.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain effective to the maximum extent permitted by law.

Our failure to enforce a provision does not waive our right to enforce it later.
